⟦ COMMISSIONS ⟧

By commissioning me you understand and agree to the terms of service below.Any statement can be bound to change if discussed with me, the artist, prior to the commission.Be sure to read my Terms of Service in their entirety before submitting your order. This will protect me (the artist), and you (the client). These terms are legally binding.

I. GENERAL TERMS.✦ I, the artist, have every right to decline your commission for any reason which does not need to be provided
✦ Rude behavior will not be tolerated by all means
✦ Picture References MUST be provided. (e. g. Photographs, drawings, artworks, crafts...)
✦ If I suspect attempted infringement of another artist’s work, commission will be rejected and client will be banned from future commissions and other artists will be informed of said infringement.
✦ My artwork is to be never in any way, shape or form used for the purpose of AI training or put through any Artificial intelligenceII. PAYMENT
✦ All commissions can be paid:
1. 50% up-front, rest will be paid after completing said commission.
2. 100% up-front✦ You, the client, will be sent an invoice with a detailed explanation of your commission (No matter the payment method)
✦ The currency accepted USD/EUR (PayPal) (Conversion rates DO apply when choosing a currency to pay with).III. PROCESS
✦ Work In Progress will be given to the commissioner (unless specified otherwise which will be noted in the invoice)
✦ During the process of sketching, as WIP's are provided, you may ask for changes to said sketch(es).
✦ The time for your commission to be completed can be up to 1.5 months give or take depending on many factors such as; health, order of commission, complexity, work, school or family issues.✦ If any of the things stated above occurs you will be notified ASAP.IV. CUSTOMER SATISFACTION
✦ I will do everything I can to make my customers happy, however, after a commission is finished, only small changes are allowed to be made such as small coloring/marking mistakes.
✦ Any great changes will come with an extra charge such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely.
✦ If your reference was unclear to start with, then you are not allowed to do specific changes without a fee. Make sure to be clear in your order what you aim for!V. COPYRIGHT / USAGE POLICY
✦ I, the artist, hold every right to the produced drawing, not the client.
✦ Therefore I´m allowed to use the copyrighted artwork to: promote myself with in any place or site, publish books with, to display it anywhere to my liking, post it wherever I want (With the client being mentioned as the commissioner).
✦ The commissioner is allowed to: use the copyrighted artwork for personal use only unless agreed otherwise, print the art and claim the right of their character(s) but not the drawing itself, use it as a profile picture (with credit given to me in the description)
✦ Using the art to promote one's brand (through social media and multiple platforms), a banner, on Twitch/Discord as emotes and etc. is NOT permitted unless commissioner has purchased promotional rights with the drawing (which will be discussed with commissioner and a certain price will be added to the detailed invoice accordingly) (more in section VI. "Personal /promotion/commercial rights")
✦ If you break the copyright infringement in any way, every right you had to the drawing will be retracted.The following is considered Copyright infringement:1. Reproducing/using the copyrighted artwork commercially (Meaning making money of it in any way) without paying the commercial rights fee
2. Taking Credit for the creation of the artwork.
3. Removing any watermarks/signatures.
4. Altering the artwork without my, the artist´s, consent.
5. Using any artwork of mine whether commissioned or not for the purpose of training AI or creating AI imageryVI. PERSONAL /PROMOTION/COMMERCIAL RIGHTS
✦ Promotion rights (such as using my art for Twitch, Discord, promoting one's brand on one or multiple sites/social media platforms, etc.) are NOT granted until customer and I agree on a price (which can go from x4 to x7 the base price) and I have been paid for said rights. Only after being paid the mutually agreed price does the customer have permission to use the commissioned drawing for promotion purposes.
✦ Commercial rights (such as printing, selling, distributing, etc.) are NOT granted until customer and I agree on a price (which can go from x7 to x11 the base price depending on customers commercial project plans and details) and I have been paid for said rights. Only after being paid the mutually agreed price does the customer have permission to print, sell, distribute, etc. the commissioned artwork.
✦ After gaining commercial rights I, the artist, still have to be credited as the original creatorVII. CANCELING/REFUNDING POLICY
✦ I have the right to cancel and refund the money for your commission at any time.
✦ If any kind of payment (Options 1 or 2 from segment II PAYMENT) has not been received in 4 days after receiving a PayPal invoice, your commission will be rejected.
✦ You have the right to request a 10% refund if the provided sketches do not suit your taste.
✦ If you file a chargeback AGAINST me after discussing canceling/refunding, your right to everything I have ever made for you will be retracted you will be forbidden to ever commission me, CJLullaby, ever again. Your username will be publicly posted everywhere I want for others to watch out and take notice.
✦ I have every right to file a complaint and I have all the right to the money you have given me.

⟦ ADOPTABLES ⟧

By purchasing/editing/co-owning & owning/re-posting/reselling/gifting/trading any adoptable from me you understand and agree to the terms of service below.Any statement can be bound to change if discussed with me, the artist, prior purchasing/reselling/editing/co-owning & owning/reposting/reselling/gifting/trading.Be sure to read my Terms of Service in their entirety before paying for your adopt. This will protect me (the artist), and you (the client). These terms are legally binding.

I. PURCHASE
✦ Purchase claims (Bids) are reached through comments on the adopt submission only (No Notes/DMs with purchase claims are accepted)
✦ All adopt payments are upfront. Payment is through PayPal (USD/EUR) (Conversion rates DO apply when choosing a currency to pay with)
✦ With each purchase of an adopt, an invoice will be sent to the buyer and the buyer is required to read and agree to these Terms of Service.
✦ Holds are allowed. An adopt can be held for 3 days. In case the client can't pay for the adopt after 3 days of holding, the adopt will be back up for sale and the client (for whom the adopt was on hold) will not be able to hold any future adopts.
✦ If payment isn't received within 5 hours after the invoice is sent, the adopt will be put up for sale again.
✦ After purchase has been cleared the client will always be asked if they want to receive a full resolution file of the adopt.II. EDITING
✦ You are free to make MINOR edits to your adopt as you please as long as the adopt is still recognizable.  (i.e: Gender, Hair color/length, eye color, skin color, clothes, markings etc.)
✦ You may edit my adopt art if it's absolutely necessary.
✦ You may not make twins/triplets/quadruplets/quintuplets w/e. One adopt stays one adopt.III. CO-OWNING & OWNERSHIP (+ COMERCIAL RIGHTS)
✦ When owning any design by me, I will not acknowledge co-owners. Designs can be shared, but one person must be acknowledged as the sole owner.
✦ My adopts are primarily meant for non-commercial use (aka my adopts may not be used in anything that will turn up a PROFIT be it games, books, videos, art pieces, merchandise, comics etc.) unless a specific fee is agreed upon and paid though a detailed PayPal invoice.
✦ You may make charms/shirts/prints/business cards/post cards featuring the character you have purchased FOR PERSONAL USE and so long as they are made in limited quantity, and the art is your own art or art purchased from another user with explicit permission from them to use their art in such a way.
✦ If commercial rights have been purchased with the adopt, making charms/shirts/prints and etc. are permitted (so long as the invoice has been paid for beforehand)
✦ You may not claim to be the creator of the design, only the owner of the character.
✦ You must credit me as the creator of the design.IV. RE-POSTING
✦ The purchaser of my adopt may repost the art they've received (With credit to the design given to me (CJLullaby))
✦ Public reposts are as well allowed as long as credit is given to me and a link to my account (Instagram or Twitter) is added to avoid easy thievery.V. RESELLING/TRADING/GIFTING
✦ Reselling is allowed under these circumstances:
✦ You may not resell the adopt for more than what you paid (unless it comes with extra art you commissioned)
✦ You may NOT raise the price to account for personal art YOU made for the adopt.
✦ You may not resell an adopt you got in a trade under any circumstances.
✦ Trading is allowed BUT you may not trade (or resell) an adopt you received for free. (i.e: as a gift).
✦ Gifting is allowed.VI. CHARGEBACK
✦ If you file a chargeback AGAINST me after acquiring the adopt and not following the ToS mentioned here, your right to everything I have ever made for you will be retracted
